A minority shareholder of CMC Holdings Ltd has been allowed to sue the firm’s management for fraud. Commercial Judge Daniel Musinga yesterday allowed Daniel Kabuba to pursue legal proceedings for "breaches that the management is not willing to handle". Justice Musinga said Kabuba has the legal rights to institute a derivative action against the firm. “Since the company is currently unable to commence action against Jeremiah Kiereini and Martin Foster due to the directive issued by the CMA, Kabuba should not be prevented from commencing a derivative action,” he added...
